ALBERT EINSTEIN The Article 19(1) (a) of the Constitution of India states that, “all citizens shall have the Right to Freedom of Speech and Expression”. Freedom of Speech and Expression has been incorporated as a fundamental right under a part III of the Indian Constitution. The philosophy behind this Article lies in the Preamble of the Constitution, where a solemn resolve is made to secure to all its citizen, liberty of thought and expression. However, in the present scenario, the violation of this right is largely being affected by some belligerents of society who does not respect other’s view and tries to impose their views upon their thoughts, feelings upon others. Hence, the present study was conducted to analyze the right of freedom of speech and expression along with various other aspects related to it. An extensive study of various judgements was made to comprehend various emerging shadesof this right and their influence upon the individual and the society.
